It is important that you read and understand this statement before Booking.
This agreement sets out the terms upon which Norton Motorcycles (Event Organisers) (U /We) agree to loan (on a temporary basis) a motorcycle for you (“the Borrower”) to undertake a supervised test ride under the control of our event partners – The Motorcycle Experience (UK) Limited (Event Organisers).
1. A strict ZERO TOLERANCE to alcohol or drugs policy has been adopted for this event and any Borrower showing traces of alcohol on breath testing or who in the opinion of any Show Organiser or member of the management or Outrider team (The Motorcycle Experience (UK) Limited) shows signs of drug abuse or drug intoxication will, without exception, be refused access to the motorcycle.
2. The event Organiser request that the Borrower reports to the test ride area at least 20 minutes before the stated ride out time to attend a safety briefing and put on suitable protective clothing. Failure to attend within this time scale may lead to your test ride being postponed or cancelled.
3. Ownership of the motorcycle shall at all times during the test ride and during the show remain with the Event Organisers or its suppliers and in allowing the Borrower to test ride the motorcycle shall not, in any way, be deemed to grant any rights or ownership whatsoever in the motorcycle to the Borrower.
4. The loan motorcycle that you will ride may be insured on a Third-Party Basis only. Please note that should you be involved in an incident which is later proved to be as a result of your own negligence or failure to respond to instructions or the prevailing road conditions you may be liable for the cost of repair to the loan motorcycle. The level of insurance cover will be subject to the terms and conditions of the insurance policy which is in force and can be communicated to the Borrower upon request. In agreeing to borrow the motorcycle, the Borrower agrees to act in a lawful and responsible manner and not do anything which is likely to contravene any applicable laws or render the insurance policy void.
Wherever possible the motorcycle will be provided in a clean condition with sufficient fuel to complete the test ride.
6. The motorcycle must be returned to the designated representative of the event at the end of the loan period, which is approximately 40 minutes, and after expiry of this period the motorcycle must be returned on demand by The Motorcycle Experience (UK) Limited.
7. In the event that the any motoring or traffic offences and resultant penalties or fines are issued or incurred during the loan period whist the Borrower is responsible for the motorcycle, these will be the sole responsibility of the Borrower. Thereafter, any notices received by Norton Motorcycles Ltd, The Motorcycle Experience (UK) Limited, or its suppliers relating to these penalties will be forwarded to the Borrower at the address below and the relevant parties (Police/Clerk to the Justices) will be informed of the Borrower’s contact details as required.
8. In the event of a breach of these conditions (and specifically the warranties set out in the declaration below, causing the insurance cover to be invalidated or where the insurer has disclaimed liability), all liability will be borne by the Borrower who shall be responsible for paying all costs and expenses resulting from this liability.
9. The Borrower shall be responsible for and reimburse Norton Motorcycles, The Motorcycle Experience (UK) Limited, or its suppliers in full for all costs or expenses suffered or incurred as a result of any claim for loss or damage (either to the motorcycle, property or another person) arising as a direct result of the Borrower’s actions whilst in the control and possession of the Borrower.
In the event of any accident occurring during the loan period, all accidents must be reported to Norton Motorcycles Limited and The Motorcycle Experience (UK) Limited. The Borrower agrees further to protect the interests of Norton Motorcycles Limited and The Motorcycle Experience (UK) Limited and its insurance cover in case of accident by:
(a) Obtaining names and addresses of parties involved, and of witnesses;
(b) Not admitting liability or guilt or settling of claims to any persons involved;
(c) Not abandoning the motorcycle without adequate provision for safeguarding and securing the same;
(d) Notifying the police immediately if another party’s guilt has to be ascertained, or if any person is injured;
(e) Completing The Motorcycle Experience (UK) Limited accident report on return of the vehicle.
11. Motorcycling is a physically challenging activity. Riding a motorcycle can be dangerous and carries with it its own unique risks. These risks can never be fully eliminated and include damage to personal property, serious personal injury, including permanent disability and paralysis, and death. In the absence of any negligence or other breach of duty by Us, participation is entirely at your risk, and We accept no responsibility for any injury or loss.
12. It is the Borrower’s responsibility to store their belongings safely while participating in the Test Ride and Norton Motorcycles Limited and The Motorcycle Experience (UK) Limited are not responsible for any theft, damage, destruction or loss of the Borrower’s property or belongings.
13. Norton Motorcycles Limited, The Motorcycle Experience (UK) Limited, or any of the organisers of the event reserve the right to refuse the Borrower to participate in the chosen event without explanation.
By participating, I understand that I have voluntarily accepted the risk of death, personal injury or loss and damage to my person or property and that such risks may arise through no fault of my own. I WARRANT THAT:
• I am 21 years or over, and under 75 years of age;
• I have not consumed any alcohol within the last 24 hours nor am I under the influence of drugs, or illegal substances or any medication which might impair my judgment or ability to ride safely
• I am medically fit to take part in the activity and I am not aware of any medical conditions which might affect or prevent me from riding a motorcycle;
• I possess and have presented for inspection a full drivers licence which I have held for at least 12 months for the class of vehicle being driven or used;
• I have not been disqualified from riding in the last 3 years
• I have accumulated no more than 5 points on my UK Driving licence during the last 3 years:
• I have not been convicted within the last 3 years of any driving offence involving drink or drugs or that resulted in a driving disqualification;
• I am not currently banned or suspended from riding as a result of a recent prosecution or offence nor am I aware of any circumstances under which my licence may not be valid at the time of taking this Motorcycle Live Test Ride Activity and have no prosecutions for such offences impending.
• I understand that I must listen to and understand the safety briefing given to me by any representative of The Motorcycle Experience (UK) Limited, or Norton Motorcycles Limited
• I understand and agree to the terms of the Loan Agreement and have had the opportunity to ask questions where necessary.
• I acknowledge that all information given in this form will be processed and held in accordance with The Motorcycle Experience (UK) Limited, or Norton Motorcycles Limited privacy policy and that I have had the opportunity to review a copy.
